1. Definitions
- "PulseDesk" means the clinic management platform and all related services operated by Zhecker Technologies Private Limited
- "Company" means Zhecker Technologies Private Limited (CIN: U58200MP2025PTC077301)
- "Clinic" means any healthcare provider, clinic, or medical practice that subscribes to PulseDesk
- "User" means any individual who accesses PulseDesk, including clinic owners, receptionists, and doctors
- "Patient" means any individual who books an appointment or interacts with PulseDesk through a clinic's WhatsApp number
- "Services" means all features and functionality provided through PulseDesk
2. Eligibility and account registration
To use PulseDesk, you must:
- Be a legally registered healthcare provider or employed by one
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your login credentials
You are responsible for all activity that occurs under your account. Notify us immediately at support@pulsedesk.in if you suspect unauthorised access.
3. Permitted use
PulseDesk is licensed for use solely for legitimate clinic management purposes. You may use PulseDesk to:
- Manage patient appointments and queues
- Send appointment confirmations and reminders to patients via WhatsApp
- Manage doctor schedules and availability
- Maintain patient records within your clinic's scope
4. Prohibited use
You must not use PulseDesk to:
- Send unsolicited commercial messages or spam to patients
- Collect or process patient data beyond what is necessary for their medical appointment
- Share patient data with third parties without explicit patient consent
- Impersonate any person or organisation
- Attempt to reverse engineer, hack, or disrupt the platform
- Use the platform for any purpose that violates Indian law, including the IT Act 2000, Digital Personal Data Protection Act 2023, or any applicable healthcare regulation
- Violate Meta's WhatsApp Business Platform policies
5. WhatsApp usage
PulseDesk uses the Meta WhatsApp Business Cloud API. By using PulseDesk's WhatsApp features, you agree to:
- Comply with WhatsApp's Business Policy
- Only send messages to patients who have opted in to receive communications
- Only use approved message templates for marketing or re-engagement messages
- Not use WhatsApp to send messages unrelated to the patient's medical appointment
- Honour opt-out requests immediately when a patient replies "STOP"
The Company reserves the right to suspend your WhatsApp integration if we receive complaints or detect misuse.
6. Patient data and HIPAA-equivalent obligations
As a clinic using PulseDesk, you are the data controller for your patients' personal and health information. You agree to:
- Obtain appropriate consent from patients before collecting their personal data
- Handle patient data in compliance with applicable Indian healthcare privacy regulations
- Not use patient data for purposes beyond direct patient care
- Inform patients that their appointment management is handled through PulseDesk
7. Subscription and billing
PulseDesk is offered on a subscription basis. For current pricing, contact support@pulsedesk.in.
- Subscriptions are billed monthly or annually as selected during signup
- All fees are in Indian Rupees (INR) and exclusive of applicable taxes
- Subscriptions auto-renew unless cancelled before the renewal date
- Refunds are at the Company's discretion and will be assessed on a case-by-case basis
- The Company reserves the right to change pricing with 30 days' notice
8. Free trial
New clinics may be offered a free trial period. During the trial:
- Full platform features are available
- No payment is required
- The trial automatically ends at the conclusion of the trial period
- Data created during the trial is preserved if the clinic subscribes
9. Intellectual property
All intellectual property in PulseDesk — including software, design, trademarks, and content — belongs to Zhecker Technologies Private Limited. You are granted a limited, non-exclusive, non-transferable licence to use PulseDesk during your subscription period.
You retain ownership of all data you input into PulseDesk, including patient records and clinic information.
10. Service availability
We aim for 99.5% uptime but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance. We are not liable for downtime caused by third-party services including Meta/WhatsApp, cloud infrastructure providers, or internet connectivity issues.
11. Limitation of liability
To the maximum extent permitted by Indian law, Zhecker Technologies Private Limited is not liable for:
- Any indirect, incidental, or consequential damages arising from your use of PulseDesk
- Loss of patient data due to circumstances beyond our reasonable control
- Delays or failures in WhatsApp message delivery due to Meta's infrastructure
- Any clinical decisions made by medical professionals using data from PulseDesk
Our total liability is limited to the amount you paid for PulseDesk in the 3 months preceding the claim.
12. Termination
Either party may terminate the subscription at any time. Upon termination:
- Your access to PulseDesk will cease at the end of the current billing period
- Your data will be retained for 12 months and then permanently deleted
- You may request an export of your data within 30 days of termination
The Company may terminate your account immediately for material breach of these Terms, including misuse of WhatsApp, data misuse, or non-payment.
13. Governing law
These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts of Gwalior, Madhya Pradesh, India.
14. Changes to these Terms
We may update these Terms at any time. Material changes will be communicated by email 30 days in advance. Continued use of PulseDesk after changes constitutes acceptance.
